How a vehicle ends up in the council pound
Vehicles are taken to the council pound through two routes: civil enforcement (parking enforcement officers issue a penalty charge notice and arrange removal for vehicles causing an obstruction, parked on yellow lines, or blocking a dropped kerb) and police-instructed removal (under Section 99 Road Traffic Regulation Act 1984 for vehicles causing danger or obstruction on a public road).
Civil enforcement removal is carried out by the council's contracted recovery operator. The council does not need a court order; the enforcement officer simply authorises the removal after issuing or attempting to issue a PCN. The keeper is liable for the removal charge regardless of whether they received the PCN.
Police-instructed removal is similar but triggered by a constable or a traffic officer rather than a civil enforcement officer. The police power applies to vehicles involved in collisions, abandoned vehicles on public roads, and vehicles causing danger. The removal charge is set by the police force's contracted rate.
